Mitigating FSRU Bottlenecks: Managing Slot Allocations, Regasification Compliance, and Demurrage Liabilities
A Missed LNG Slot Can Trigger Four Different Contracts
European LNG import capacity has expanded substantially since 2022, including new floating storage and regasification units. That infrastructure has strengthened supply flexibility, yet an LNG cargo still has to pass through a narrow operational sequence: vessel arrival, berth availability, unloading, regasification, terminal exit and downstream network delivery.
A disruption at one point can trigger obligations elsewhere. A vessel arriving four days late may lose its terminal window. The same delay can create demurrage under the charter party, affect cargo-delivery obligations under the LNG SPA and force the importer to amend or replace downstream gas nominations.
These liabilities are rarely governed by one agreement. The terminal-use contract, LNG sale documentation, charter party and transmission arrangements use different triggers, notice rules and remedies. Relief under one document has no automatic effect on another unless the contractual chain has been aligned in advance.
For an LNG import desk, the relevant legal task is therefore to understand the sequence of physical events and map each event to the contract that allocates its cost.
Where a Four-Day Delay Creates Cascading Exposure
A disrupted LNG call can generate several categories of exposure at the same time. Three interfaces usually determine whether the loss stays contained:
Terminal Capacity
The terminal agreement governs the allocated slot, berthing window, capacity rights, substitution or transfer options, operational notices and the consequences of non-use.
Vessel & Cargo
The LNG SPA and charter-party documentation allocate arrival risk, laytime, demurrage, title transfer, cargo readiness, boil-off gas and delivery obligations.
Downstream Grid
Regasification capacity and transmission capacity are separate. The importer must manage entry capacity, nominations and balancing exposure under the relevant TSO and national market rules.
The financial result depends on how those interfaces interact. A slot swap may solve the terminal problem while leaving demurrage unresolved. A force majeure event under the SPA may provide relief between buyer and seller while the terminal agreement continues to apply its own missed-slot mechanism.
LNG Terminal Access in the Current EU Gas Framework
The EU gas-market framework changed materially with Regulation (EU) 2024/1789 and Directive (EU) 2024/1788. Regulation 2024/1789 has applied since 5 February 2025 and now contains the directly applicable rules on access conditions for natural-gas transmission, storage and LNG facilities.
LNG system operators must offer services on a non-discriminatory basis and under equivalent contractual terms for equivalent services. They must also offer bundled and unbundled LNG-facility services according to user demand and publish information on contracted and available capacity.
The capacity framework has also become more operationally relevant for congestion management. The Regulation requires LNG operators to facilitate capacity trading and, by 5 February 2026, to ensure access to a transparent and non-discriminatory booking platform through which users can resell contracted LNG capacity on the secondary market.
These EU rules do not make terminal slots interchangeable across Europe. Allocation procedures, open seasons, capacity products, operational tolerances and penalties still depend on the terminal, national framework and any infrastructure-specific exemption. The current access regime therefore has to be read together with the terminal’s own rules and contract.

Case Study: €220,000 of Exposure After a Missed FSRU Window
The Disruption
An international utility import desk held a firm regasification slot at a major European FSRU terminal. The LNG cargo had already been sold onward to industrial consumers, with downstream delivery dependent on scheduled grid injections.
A severe maritime storm and resulting port disruption delayed the carrier arriving from the US Gulf Coast by four days. The terminal was operating close to capacity and the original discharge window could no longer be used.
The Contract Chain
The missed slot created several simultaneous claims. The terminal operator asserted non-performance exposure under the capacity arrangement. The vessel delay created demurrage risk. The importer also had to deal with downstream nomination and sales obligations because the gas was unavailable on the original timetable.
The direct exposure exceeded €220,000 before the importer had secured an alternative discharge route.
The immediate response focused on terminal capacity. Emergency allocation procedures were activated and a rapid capacity swap was negotiated with a regional market participant, creating an alternative discharge window. Contractual relief provisions were used to preserve the client’s position while the operational solution was implemented.
Force Majeure Has to Be Aligned Across the Contract Chain
Weather disruption is a useful example of why LNG contracts should be reviewed as a chain. A storm may qualify for contractual relief under one agreement and fail to satisfy the wording, causation test or notice requirement under another.
The LNG SPA may address force majeure, delivery windows and alternative delivery arrangements. The charter party may contain separate provisions for weather, port closure, berth availability and laytime. The terminal-use agreement may define slot tolerance, permitted rescheduling, capacity transfer and consequences of non-use. Downstream sales contracts can impose their own delivery and replacement-gas obligations.
Contract alignment should therefore answer a practical sequence of questions. When does the delay become legally relevant? Which party must give notice? How quickly? Does relief suspend performance, extend time or excuse a payment? Can terminal capacity be transferred? Can the cargo be diverted? Who bears the cost of replacement gas?

Demurrage Depends on the Vessel Record, Not the Headline Delay
A four-day delay does not produce one automatic demurrage result. The legal position depends on the charter party and the sequence recorded by the vessel, port and terminal.
Key evidence can include the notice of readiness, statement of facts, berth availability, port-control instructions, weather records, terminal communications and the point at which laytime commenced, stopped or resumed. Responsibility for congestion can also differ where the vessel is ready to discharge but the berth, port authority or terminal cannot receive it.
For the importer, the first priority is preserving notices and contemporaneous operational evidence. Commercial discussions around slot substitution or a terminal swap should not destroy rights under the charter party or LNG sale documentation.

Terminal Capacity and TSO Capacity Are Separate Risk Layers
Securing a new LNG discharge window solves only part of the logistics chain. Once the gas is regasified, the importer still needs the network rights and nominations required to place that gas into the relevant entry-exit system.
Regulation (EU) 2024/1789 preserves the entry-exit model for natural gas and places balancing responsibility on network users. An LNG terminal booking therefore should not be treated as a substitute for transmission capacity or downstream balancing arrangements.
A delayed cargo may require nomination amendments, replacement purchases, capacity rebooking or balancing action. The commercial deadline can be much shorter than the legal dispute over the original delay.
The LNG desk should therefore maintain a disruption protocol that identifies who contacts the terminal, shipowner, TSO, downstream buyer and financing bank, and which contractual notices must be issued in parallel. The objective is to keep the operational response moving while preserving the legal allocation of the resulting cost.
In the FSRU case, the alternative terminal window protected the downstream sales position and removed the immediate terminal-failure exposure, mitigating approximately €220,000 in direct losses.
What LNG Importers Should Check Before the Vessel Sails
- Map the full delivery sequence. Identify the contractual hand-off from cargo seller to vessel, terminal, transmission system and downstream buyer.
- Compare every timing definition. Arrival window, notice of readiness, laytime, terminal slot, nomination deadline and downstream delivery period should work together.
- Check capacity-transfer rights. Review whether unused terminal capacity can be resold, transferred, swapped or substituted and which approvals are required.
- Align force majeure notices. One operational event may trigger several agreements with different notice periods and evidentiary requirements.
- Separate terminal and grid capacity. Confirm transmission entry rights, nomination procedures and balancing exposure independently from the regasification booking.
- Preserve the maritime record. Vessel notices, port instructions, statements of facts and terminal correspondence can determine the outcome of a later demurrage claim.
- Define the replacement-gas strategy. The importer should know who can procure substitute volumes, who bears the cost and whether downstream contracts allow rescheduling.
Conclusion: LNG Logistics Risk Lives Between the Contracts
An FSRU slot is one component of a larger delivery system. Vessel performance, terminal access, regasification, transmission nominations and downstream sales remain legally separate even when they form one commercial transaction.
The strongest LNG structures anticipate the points where those contracts can diverge. They provide workable notice procedures, capacity-transfer options, replacement routes and clear rules for allocating delay costs before a vessel misses its window.
In the €220,000 case, the decisive step was an operationally usable capacity solution supported by the existing contractual framework. The slot swap protected the downstream position and removed the immediate terminal penalty exposure while the remaining claims were managed separately.
That sequence is the practical measure of LNG contract resilience: the documentation must allow the importer to keep the gas moving while preserving its rights against the parties responsible for the disruption.
